Any of these terms and statements are bound & subject to change without any notice.
By purchasing a commission the client is automatically bound to these Terms of Services.
This page may be updated periodically. First-person references, (I, Me, Myself) within these conditions refer to the artist of the commission transaction.Client will refer to the customer, or purchaser, of the transaction.If a client has any questions about these terms they are encouraged to email their inquiry directly to [email protected]
Terms of Services - General
1) ALL submissions are looked over in my selection! Acceptance of a commission is not guaranteed. I have the right to refuse the request of a commission without the need of an explanation.2) I will not reproduce any copyrighted material without the consent of the original owner.3) I retain all rights to the commission, such as distribution, reproduction, and use of promotion.4) The client may not edit*, distribute, reproduce, claim credit of, trace, or profit from the commission.
a) The client under normal circumstances may essentially crop or saturate the commission.
b) Larger edits or alterations must be addressed to me including the purpose.5) Clients have permission to display the commission on profiles, however the watermark or original signature must be included in any credible form.6) I may alleviate and or give certain permissions/consent regarding the usage of the commission.7) The rough-draft/preview and final piece will be emailed or sent by Discord in .PNG format, only at the request of the commissioner.8) Refunds will not be issued after the process has begun.9) I am not subject to any shipping or handling regarding the deliverance of the commission.10) The commission must not breach any of the relevant terms. Should any of these terms be violated, all forms of communication or collaboration will be discontinued.11) I will begin to work once the full payment after the sketch has been received.12) Payment is expressed using USD via PayPal. An invoice will be sent once I have confirmed your submission.
(a) The Payment will charge the PayPal tax too, as for the example: $200 + %5 ($10) = $21013) Minor changes (including references), details or errors must be addressed 24 hours before request submission, or after initial sketch and final product. On my behalf, I will fix and address any error/alterations, and include a fixed submission within the same given time frame.14) After full payment, the commission may approximately take 6 days to 2 weeks, or up to 1 month to complete. Factors or events that may hinder the process & approximate time frame will be immediately addressed. Completion time will be extended should any of this occur.15) I will to the best of my ability fulfill not only the customer's satisfaction but mine as well!
All commissions will be expressed with more effort than my non-formal works and commissions.16) Please note that my art style leans towards SFW and SOFT NSFW (slight ecchi not hard NSFW).
Unless stated otherwise in your submission, you may specify if you would like Safer changes to the composition.17) Prices are subject to change. If a price for an item were to change after the time of purchase, the client will not be reimbursed or billed the difference.18) If you don’t reply to my message after I send the sketch in 12 hours, I will cancel your request.
a) If you cancel your commission, there’s no refund after I finish working on the sketch color.
b) Max revision is 2, more than that I can decide to continue or cancel your commission. If I continue, you will be charged $15 per revision and if I decide to cancel your commission I will refund 50% of my price.19)My artwork is never to be used in NFT’s, whether you bought it or not.
Terms of Services - Commercial
1) Clients looking to have work marketed for profit must reach out to me and receive permission in written documented text.2) Clients are not permitted, under any circumstances, to use any part of their finished commission for non fungible tokens. Use of my artwork for any advertising or profits associated with non fungible tokens, blockchains, or cryptocurrency is strictly prohibited.3) I will never sell/resell any of my work as non fungible tokens. If artwork I have created, regardless if commissioned or personal, is listed as a non fungible token or is being resold for cryptocurrency, it is stolen. Please report any reposts or resales to me promptly.4) I will not resell a client's commissioned work for profit without their written consent.*exceptions apply to: if the commission was abandoned or cancelled while incomplete in which case, depending on the amount of work done, a print may be repurposed or resold. Any elements that are the client's property [i.e, characters] will not be used in this resale/repurposing, and will be replaced with either my own or another client's character[s].
Terms of Services - Publisher
1) I reserve the right to display commissioned artwork for advertising and self promotion purposes, unless the client explicitly requests their commission be private. This must be noted at the time of purchase or before the artwork is completed.2) The client may print their purchased artwork for their own personal use, provided it is not for profitable means.3) Should the client wish to credit me, they may link to any of my social media, credit under the name MICORY, or link directly to my Twitter @RaoMicory4) The client is welcome to publish their purchased artwork on their own social media, in online art galleries, and in online character archives. the client may use, print, or crop their purchased artwork for private nonprofit use, such as social media banners, icons, backgrounds, physical art prints, or physical stickers. This is provided my credit stamp [signature] remains intact on the artwork.*5) If my signature or logo watermark is cut off due to the image being cropped, such as for a social media icon or banner, the client is not required to move or rewrite my signature on the cropped artwork.
Terms of Services - Copyright
1) The artwork is for personal use purposes, commercial commission will be doubled the initial price. Please let me know what kind of purpose you are going to do with my artwork.2) I reserve all the rights to my artwork.3) If it's for commercial use, we can discuss it first. The fee will be 2x from the original prices but it depends on what commercial.4) Personal use: you can’t sell my drawing as poster, sticker or any kinds of merchandise, use it on your stream, used as a profile picture on twitch are fine but not for banner or cover, don’t use my artwork to promote yourself unless i give you fanart, feel free to use it as wallpaper or anything for yourself only.5) Reproducing or using my artwork without my permission is prohibited.
